In a recent article by The Associated Press, Bank of America is testing a housing program that will let some homeowners at risk of foreclosure become renters and stay in their homes. For the time being the program is being tested by fewer than 1,000 borrowers in Arizona, Nevada and New York. These Citys will be enrolled in the test program, which began this week. Those selected will transfer the title of their homes back to B of A and have their mortgage debt forgiven. Hopefully, this program will be available in the near future for Utah Homes in Foreclosure.

Here are the highlights of the Program:

• Rent out home for three years at current market rate
• Rental payments will be less than the borrowers’ mortgage payments
• Will not have to pay property taxes or homeowner’s insurance.
• Must have  enough steady income

The program, called “Mortgage to Lease,” uses an old but increasingly popular technique for lenders. It’s called a “deed in lieu of foreclosure.” It occurs when homeowners turn over the deed to their house to their lender because they can’t make the monthly payments.

The technique was used during the Great Depression but fell out of favor after the 1930s.

The trick will be to find home owners who are struggling with bloated mortgage payments but who have enough steady income to safely make smaller rental payments.

Foreclosures can be pricey and time-consuming for lenders, which have been seeking alternative ways to cut costs. The average foreclosure takes nearly two years to complete, according to Florida-based Lender Processing Services, and costs nearly $78,000, according to a congressional estimate.

B of A  says it’s targeting homeowners who are at “considerable risk” of foreclosure; have high loan balances relative to their home’s value; have exhausted all loan modification programs; and have been delinquent on their mortgage payments for more than 60 days.

“If this evolves from a pilot into a more broadly based program, we also see potential benefits from helping to stabilize housing prices in the surrounding community and curtail.

Utah Foreclosure Auction

In a recent article by The Associated Press, Utah Homes that have been Foreclosed upon in 2009 and 2010, are now  under review due to Lenders seizing to quickly and not reviewing documents.  About 4 million homeowners who may have been improperly foreclosed upon are getting an opportunity to have their cases reviewed after investigations from the government.

Here are some of the  nation’s 14 largest mortgage servicers which are under review—  Citibank, Bank of America, JPMorgan Chase and Wells Fargo

The orders require the lenders to pay homeowners when a “borrower suffered financial injury.” There is no minimum or maximum dollar amount identified.

Regulators say independent consultants will also review the cases and the reviews would take many months. If a consultant finds a lender erred, it will conduct follow-up reviews on other cases to see if the lender is trying to dodge blame.

“The challenge is substantial, but the steps we have required the servicers to take are vitally important to resolving these issues in a way that respects the rights of those who have been harmed and helps to restore confidence in the system,” said John Walsh, acting Comptroller of the Currency.

In the four years since the housing bust, about 5 million homes have been foreclosed upon. About 2.4 million primary mortgages were in foreclosure at the end of last year. Another 2 million were 90 days or more past due, putting them at serious risk.
